Can a report about a slip and fall be useful to settling the case?

We recently had a case of a 51-year-old woman who suffered a slip & fall in the produce department of a local supermarket. The entire accident was captured on in-store video including the client hitting her head during the accident. The client immediately complained of headache, dizziness, confusion, difficulty with word finding, neck pain with pain and bilateral numbness radiating to her hands, tingling and numbness in her right middle finger and pain between her scapulae. She was noted by her 17-year-old daughter, who witnessed the event, to have “some jerky movements” after the fall.
We interviewed the client and some of her family members by telephone after reading the medical records and viewing the store video. Unfortunately, the client’s symptoms did not fully resolve and she is left with three main sets of problems from the slip and fall. She suffers from Chronic Post-Concussion Syndrome with significant cognitive loss, neck pain radiating bilaterally to both upper extremities characterized by pain, numbness, tingling and weakness and finally anxiety.
The value of our report was not only to render our medical opinions about the client’s ongoing injuries but also to give our opinions regarding the client’s future medical care and costs. Using our report the attorney was able to settle the case for significant damages and to make sure the client’s medical treatment and the cost of those treatments was included in the settlement without the need to take the case to trial.
